1. About Pilot Recall

Pilot Recall ("the Service") is an online study aid operated by Pilot Recall ABN [your ABN] ("we", "us", "our"). The Service provides flashcards, practice quizzes, and progress tracking to assist students preparing for Australian aviation theory examinations.

2. Study aid disclaimer

Pilot Recall is an independent study aid. It is not affiliated with, endorsed by, or connected to the Civil Aviation Safety Authority (CASA) or any other government body. Our content is written independently and does not represent official exam material, past exam papers, or guaranteed exam questions.

Our study content is generated with AI assistance and undergoes review; however, it may contain errors, omissions, or outdated information. This content must not be used as the sole basis for any operational aviation decision. You are solely responsible for verifying all information against current CASA publications, AIP, and guidance from your approved flight training organisation.

Use of this Service does not guarantee you will pass any examination. To the extent permitted by law, we accept no liability for any loss or damage arising from reliance on our content for any purpose beyond personal study.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 13 years of age to use the Service.

4. Subscriptions and payments

Pilot Recall offers a free tier and paid Pro plans. Paid plans are available as monthly or annual subscriptions.

  • Monthly and annual subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. You retain Pro access until then.
  • Refunds: In addition to your rights under Australian Consumer Law, we offer a voluntary 7-day satisfaction refund if you have not substantially used the Service during that period. To request a refund, contact us at the email address listed below. Nothing in this refund policy limits your statutory rights under the Australian Consumer Law. You may be entitled to a remedy beyond this 7-day period if the Service fails to meet a consumer guarantee.
  • Price changes: We may adjust pricing for future billing periods. Existing subscribers will be notified at least 30 days before any price increase takes effect. Your current billing period is not affected by price changes.
  • Legacy plans: Some users may hold legacy plans (such as one-time lifetime purchases) that are no longer offered. The terms of those legacy plans continue to apply as agreed at the time of purchase.

5. Acceptable use

You may not: (a) share your account with others; (b) scrape, copy, or redistribute our content; (c) attempt to reverse-engineer the Service; (d) use the Service for any unlawful purpose.

6. Intellectual property

All content on Pilot Recall, including flashcard text, quiz questions, explanations, and design, is owned by us or licensed to us. You may not reproduce, distribute, or create derivative works from our content without written permission.

7. Limitation of liability

To the maximum extent permitted by law, Pilot Recall is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. This includes, without limitation, exam results, lost study time, or reliance on content that may contain errors.

To the extent permitted by law, our total aggregate liability for any claim arising from or related to the Service is limited to the amount you have paid us in the 12 months preceding the claim.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement.

8. Indemnification

You agree to indemnify and hold harmless Pilot Recall, its directors, and its agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these terms, misuse of the Service, or reliance on our content for any purpose beyond personal study.

9. Termination

We reserve the right to suspend or terminate your account if you breach these terms. We will provide at least 7 days notice before termination unless the breach poses an immediate risk to the Service or other users. If we terminate your account without cause, you will receive a pro-rata refund of any prepaid subscription or lifetime purchase amount.

You may delete your account at any time by contacting us.

10. Dispute resolution

If a dispute arises under these terms, the parties agree to first attempt to resolve it through good faith negotiation. If the dispute is not resolved within 30 days, the parties agree to attempt mediation administered by a mutually agreed mediator before commencing any court proceedings. This clause does not prevent either party from seeking urgent injunctive relief.

11. Force majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, internet or infrastructure outages, government actions, pandemics, or third-party service provider failures.

12. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email or a notice within the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
